Mossy Toyota flood car rust damage

Old truck died, took in to Mossy service department. Cost to fix exceeded the value. Took Friday off from work to get another car to be able to get to work Monday.

Looked at two vehicles during Mossys' certified used care sale. Asked if there was accident history, advised they were not involved in previous accident. One had Carfax in the glove compartment, the other Autocheck. Test drive showed vibration. Salesman Craig said Idler needed an adjustment. Mossy would fix the problem. I get the idea that they purposefully put the cleaner of the two car check reports in the glove compartment...

During the purchase they were unaware my old truck had two names on the title. My spouse had to go back to Mossy to sign title over.

First repair attempt. Was told by Ed these cars shake.

Returned with vehicle. Asked for the car to be returned, was pretty much laughed at, "you can't return it". Was told by Craig to come back another day so they can take it over to Ford dealer.

Went to sales manager Dan with complaints. Asked for them to take it back. I was told they need to take it over to Ford which they did.

Wachovia dealer services "welcome call". Told them what has taken place. They were worried about me defaulting, warned me to maintain my credit. They were very concerned about things like this happening and doing business with Mossy. They said they will contact Mossy.

Mossy finance director Collin called aware of the problem. Advised me used car sales manager Silverio will be contacting me later this day...No call.

Wachovia called again to follow up. I told them Collin called stating Silverio would be contacting me and that he had not. They wanted me to call Collin again which I did. Collin said I need to speak with Silverio which I did. I got his email and set this time line for his better understanding of the situation before I arrived in person to explain it all. When we met I told him how frustrated I was and was willing to let them keep my down payment if they would just take the car back. He said he had a GM meeting that afternoon and he was going to discuss it at the meeting and call me back that evening...No call.

This now has been 25 days of hell at this point. The car's rear view mirrors shake so bad at a signal or stop sign that you can't see clearly through them. When the windows are up the concussion generated by the vibration rattles my eardrums. Driving to work in the dark mornings the headlight beams bounce on the ground or anything else they are shining on.

Complaint filed with BBB shortly after 3/13.

After an auto expert investigated the car and found it had been rear ended, submerged and is now rusted out and experiencing electrical shorting I secured Attorney on the 41st day.

To date I'm on the third arbitrator. The first one after reviewing the case refused to hear it. The second was dismissed by the court for bias...Had a private consulting business for auto dealers. Now the third that has a 40-0 record against consumers has a hearing April 9th to dismiss for bias.
